1. About these Terms

1.1       These Terms are between Canine Caregivers Pty Ltd, ABN 39 670 538 655 ("Canine Caregivers", "we", "us", "our") and you ("you", "Member"). Canine Caregivers is co-founded and run by Ian Shivers and Dominique Hone.

1.2       They govern the website caninecaregivers.com.au, the Canine Caregivers membership and community, the online course library, the consultation-and-membership package, and TRACE access provided through membership.

1.3       You accept these Terms when you tick the acceptance box at sign-up or checkout, pay a Fee, or use the platform after these Terms have been made available to you.

1.4       We may update these Terms by publishing the updated version on our website. Updates apply to purchases made after publication. For current Members we will email notice of any change that materially and adversely affects them before it takes effect.

1.5       Our Privacy Policy forms part of these Terms.

1.6       Relationship to Bondi Behaviourist. Bondi Behaviourist (Ian Shivers, sole trader, ABN 29 775 879 915) is a separate business. Consultations, training programs and TRACE are provided by Bondi Behaviourist under its own terms at bondibehaviourist.com/terms-conditions. Where a Bondi Behaviourist purchase includes Canine Caregivers membership, we provide that membership on these Terms.

2. Definitions

ACL means the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

Bondi Behaviourist Terms means the terms at bondibehaviourist.com/terms-conditions, including Part C (TRACE).

Community means the members-only discussion and messaging areas of the platform.

Content means the courses, webinars, short courses, recordings, documents and other material available to Members.

Fees means the prices displayed on our website or on bondibehaviourist.com/online-membership at the time of purchase, in Australian dollars.

Lifetime Membership means membership with no end date and no recurring Fee, obtained under clause 4.

Membership means any of the memberships in clause 3 or 4.

TRACE means the AI dog behaviour tool provided by Bondi Behaviourist and described in the Bondi Behaviourist Terms.

2.1       Headings are for convenience; the singular includes the plural; "including" is not limiting; no rule of interpretation applies against us because we drafted these Terms.

3. Memberships and Fees

3.1       We offer the following Memberships:

(a)     Monthly Membership — currently $35 per month, renewing each month;

(b)     Annual Membership — currently $210 per year, renewing each year;

(c)     Consultation + Membership Package — currently $375 on enrolment, which includes a two-hour online consultation and personalised training plan delivered by Ian Shivers through Bondi Behaviourist, complimentary Membership until the consultation, and then Monthly Membership at $25 per month from the consultation date; and

(d)     Lifetime Membership — currently $350 as a single payment, with no ongoing Fee (see clause 4).

3.1A     Where each Membership is sold. Lifetime Membership is sold at caninecaregivers.com.au. Monthly Membership, Annual Membership and the Consultation + Membership Package are sold at bondibehaviourist.com/online-membership. Whichever page you buy from, the Membership is provided by Canine Caregivers Pty Ltd on these Terms.

3.2       Every Membership, including Lifetime Membership, includes: access to all Content; the Community; direct messaging to Ian and Dom; member discounts and benefits; and TRACE access under clause 6.

3.3       Fees are as displayed at the time of purchase. Canine Caregivers Pty Ltd is not registered for GST and no GST is charged. We may change Fees for new purchases at any time. For an existing Monthly or Annual Membership the new Fee applies from your next renewal and we will email you before it applies. Lifetime Membership is never subject to a further Fee.

3.4       Payments are processed by Stripe through our platform. You authorise us to charge each renewal to your nominated payment method until you cancel. If a payment fails we may suspend access until it is received.

3.5       The consultation in the Consultation + Membership Package is delivered by Bondi Behaviourist and its booking, rescheduling and cancellation are governed by the Bondi Behaviourist Terms. The Membership component is governed by these Terms.

3.6       Discount codes. Where a Membership is purchased with a discount code, the discounted Fee applies for the period stated with the code, after which the standard Fee applies from the next renewal. We will remind you by email before the first standard-rate renewal.

4. Lifetime Membership

4.1       You hold Lifetime Membership if you:

(a)     purchased Lifetime Membership under clause 3.1(d);

(b)     purchased the Complete Care Program from Bondi Behaviourist;

(c)     purchased a Lifetime TRACE Membership from Bondi Behaviourist; or

(d)     were granted lifetime access by us in writing.

4.2       Lifetime means for as long as Canine Caregivers operates the platform. Lifetime Membership has no end date, no renewal and no further Fee. It is personal to you and cannot be transferred or shared.

4.3       We will not cancel a Lifetime Membership except for a serious or repeated breach of clause 7 (conduct) or clause 8 (intellectual property), and then only after giving you written notice and a reasonable opportunity to respond, unless the breach is such that immediate suspension is necessary to protect other Members.

4.4       If we close the platform or move it. If we permanently close Canine Caregivers, or move it to a different platform, we will give Lifetime Members at least 60 days' notice by email and will, at our election, either provide equivalent access on the successor platform at no further cost or make the Content available for download for at least 90 days. TRACE access that came with a Lifetime Membership is governed by the Bondi Behaviourist Terms and is not affected by a change to this platform.

4.5       Earlier purchases. Lifetime Membership obtained through a purchase from Bondi Behaviourist Pty Ltd before April 2026 is honoured on these Terms. Lifetime Memberships purchased directly from Canine Caregivers Pty Ltd continue unchanged.

5. Cancellation and refunds

5.1       You may cancel a Monthly or Annual Membership at any time from your account, or by emailing hello@caninecaregivers.com.au. There is no minimum term. Cancellation takes effect at the end of the current billing period; you keep access until then and are not charged again. To avoid a further charge, cancel before the renewal date.

5.2       You may pause a Monthly Membership from your account. No Fees are charged while paused and access is suspended until you resume.

5.3       Lifetime Membership has no recurring Fee and nothing to cancel. You may ask us to close your account at any time.

5.4       Refunds. Subject to clause 9.1, Fees are not refundable for change of mind and no refund or credit is given for the unused part of a billing period. If the platform is unavailable for more than 7 consecutive days for reasons within our control, we will extend your Membership or refund the affected period on request.

5.5       Membership included in a Bondi Behaviourist purchase is part of that purchase price; any refund is governed by the Bondi Behaviourist Terms.

6. TRACE access through Membership

6.1       Every paid Membership includes access to TRACE for as long as the Membership is active. Access ends automatically when a Monthly or Annual Membership ends. Lifetime Members have lifetime TRACE access, provided by Bondi Behaviourist under an arrangement between Bondi Behaviourist and Canine Caregivers.

6.2       TRACE is provided by Bondi Behaviourist, not by us. Your use of TRACE is governed by Part C of the Bondi Behaviourist Terms, which you accept when you first use TRACE. Those terms explain what TRACE is and is not, how your conversations are handled, and the Delphi platform on which it runs.

6.3       To provision TRACE we give Bondi Behaviourist your name, email address and Membership status, and Bondi Behaviourist tells us when your TRACE account is active. Our Privacy Policy explains this.

6.4       Bondi Behaviourist may change TRACE as described in its terms. We are not responsible for TRACE's availability, output or data handling.

7. Your account and conduct

7.1       You must be at least 18 years old. You are responsible for your account and password and must not share them or let anyone else use your Membership.

7.2       You must keep your account details accurate and up to date.

7.3       The Community is a supportive space. You must not post anything unlawful, abusive, discriminatory, misleading, or that promotes harm to a person or animal; must not post another person's personal information or images without their consent; must not advertise or solicit; and must not post content that infringes anyone's rights.

7.4       Direct messaging to Ian and Dom is for general questions and support. It is not a consultation and not an emergency service; responses are given within a reasonable time during business hours. For an individual assessment of your dog, book a consultation. If a person or animal is at immediate risk, seek help in person.

7.5       We may moderate, edit or remove Community content and may suspend or end your access to the Community or the Membership for breach of this clause. For Monthly and Annual Members, termination for breach is without refund, subject to the ACL. For Lifetime Members, clause 4.3 applies.

7.6       By posting in the Community you give us a licence to display your post within the Community for as long as it remains there. We will not use your posts outside the Community without your consent.

8. Intellectual property

8.1       All Content, the C.A.R.E. approach, the Five Pillars framework and all other material on the platform belong to Canine Caregivers Pty Ltd or its licensors (including Ian Shivers and Dominique Hone for their own material). You receive a personal, non-transferable licence to view and use the Content for your own dog and household while your Membership continues.

8.2       You must not download (except where we provide a download), copy, share, publish, sell or use the Content to provide services to others. Professional use requires a separate agreement.

9. Consumer guarantees, no guarantee of outcome, and liability

9.1       Our services come with guarantees that cannot be excluded under the ACL. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the ACL or any other law that cannot lawfully be excluded.

9.2       The Content is general education about dog training, behaviour and care. It does not address your dog individually, is not veterinary advice, and no outcome is guaranteed. Have your dog's health checked by a veterinarian before beginning any behaviour work, and seek professional help for any situation involving aggression or risk.

9.3       To the extent permitted by law, we are not liable for loss arising from your application of the Content, the behaviour of your dog, the acts or omissions of third-party providers (including our platform provider, payment processor, and Bondi Behaviourist for TRACE), or for indirect or consequential loss.

9.4       Where our liability for a failure to comply with a consumer guarantee can be limited, it is limited, at our election, to resupplying the service or refunding the Fees paid for the billing period in which the failure occurred.

9.5       You indemnify us against claims and reasonable costs arising from your breach of these Terms or your unlawful conduct on the platform, except to the extent we caused the loss.

10. Availability and changes

10.1     We do not warrant that the platform will be continuous, uninterrupted or error-free. It may be unavailable for maintenance or reasons outside our control.

10.2     We may add, change or retire Content and features. We will not reduce the overall Content or core features available to Members without reasonable notice, and clause 4.4 protects Lifetime Members if the platform closes or moves.

11. Privacy and marketing

11.1     We handle personal information as described in our Privacy Policy. Our platform is built on GoHighLevel and hosted by GoCoLab; payments are processed by Stripe.

11.2     We send marketing emails only to people who have opted in. Membership does not require opting in. Every marketing email includes an unsubscribe link. Service messages about your Membership and account are not marketing.

12. Complaints, general and governing law

12.1     Concerns about the platform or your Membership: email hello@caninecaregivers.com.au. We aim to acknowledge within two business days and resolve within 14 days. If we cannot, you may contact NSW Fair Trading, or the Office of the Australian Information Commissioner for a privacy complaint.

12.2     These Terms and the Privacy Policy are the entire agreement between you and us for the Membership. If a provision is unenforceable it is severed and the rest continues. A delay in enforcing a right is not a waiver. You may not assign these Terms; we may assign them on notice to you.

12.3     Notices to us go to hello@caninecaregivers.com.au; notices to you go to your account email.

12.4     These Terms are governed by the laws of New South Wales, Australia, and each of us submits to the courts of New South Wales.
